These terms define the general conditions and procedures for sales made by IT3D through the Online Store https://dibuprint3d.com The terms and conditions regulate the sale between IT3D and the Client/Consumer and user, who declares is a “consumer” as indicated in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, a natural person who acts with a purpose unrelated to their commercial, business, trade or profession activity.

2. Registration. Username and password
1. People over 18 years of age may legitimately register in the Online Store. The registration will be essential/will not be essential to acquire the products offered by IT3D.

3. Purchase or acquisition process.

1. All purchase orders received by IT3D through the Website are subject to the availability of the products and/or to the fact that no circumstance or cause of force majeure (“Interruption of service” clause of these Conditions) affects the supply of the products. themselves and/or the provision of services.

6. Shipping and Delivery

5. The IT3D logistics platform has been developed so that you can receive your order as soon as possible. To facilitate the tracking of the shipment, at the time the merchandise is delivered to the carrier you will receive a warning message by email with the estimated delivery date.

4.6. IT3D may withhold the reimbursement until the goods have been received, or until the client or user has presented proof of the return of the goods, depending on which condition is met first.
4.7. 7. We advise you to protect your item(s), as you will be responsible for any possible damages suffered during transport. 8. When the User returns a product in exercise of his right of withdrawal, only products that are sent with their original packaging, in a new and complete condition (with accessories, manuals, cables, etc.) will be accepted. 12. Right of withdrawal regarding the supply of digital content

Contracts in which the consumer and user have specifically requested the employer to visit them to carry out urgent repair or maintenance operations; If, during that visit, the entrepreneur provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts used necessarily to carry out maintenance or repair operations, the right of withdrawal must apply to said additional services or goods .
2.9. The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the consumer and user after delivery.
2.10. The supply of daily press, periodicals or magazines, with the exception of subscription contracts for the supply of such publications.
2.11. Contracts entered into through public auctions.
2.12. The provision of accommodation services for purposes other than housing, transport of goods, vehicle rental, food or services related to leisure activities, if the contracts provide for a specific date or period of execution.
2.13. The supply of digital content that is not provided on a material support when the execution has begun with the prior express consent of the consumer and user with the knowledge on their part that they consequently lose their right of withdrawal.
14. Product conformity
1. IT3D is obliged to deliver the products that are in accordance with the contract, responding to it for any lack of conformity that exists at the time of product delivery.
2. “As established in Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, they establish a term general 2-year warranty in case the purchase is made by a “consumer”. If the defect comes to light during the first 6 months from the delivery of the good, it is presumed to be a defect of origin, the consumer will not have to prove anything to get the guarantee to apply. If the problem manifests itself after those 6 months, the manufacturer or seller can require the consumer to prove that the fault existed from the beginning. Thus, the purchase of the 3D printer would be understood to be made by a “consumer” when, even though it was purchased by a businessman, the product is intended for a private use and is not incorporated into a business, professional or commercial activity. In this case the guarantee would be 2 years.
3. On the contrary, the businessman who, with such a condition, acquires a consumer good to use it for his commercial or business activity -even if outside the scope of his object or his specialty-, would not enter the concept of “consumer”. Therefore, the guarantee regime provided for in the TRLGDCU (arts. 114 et seq.) will not be applied. A 1-year warranty period is established, counted from the delivery of the product.
4. The choice between both actions is free for the buyer, but if one is exercised, the other is excluded.
5. Unless proven otherwise, it will be understood that the products and/or services are in accordance with the contract when all the requirements expressed below are met, unless due to the circumstances of the case, any of them is not applicable:
5.1. They conform to the description made by IT3D and have the qualities of the product that IT3D has presented to the consumer and user. Notwithstanding the foregoing, the images of the products sold through the Online Store may present certain differences with the actual product, due to color configuration or other reasons that affect the display.
5.2. They are suitable for the uses to which products of the same type are ordinarily destined.
5.3. They are suitable for any special use required by the consumer and user when they have informed IT3D at the time of signing the contract, provided that the latter has admitted that the product is suitable for said use.
5.4. Present the usual quality and benefits of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product and, where appropriate, public statements on the specific characteristics of the products made by the seller, the producer or his representative, in particular in advertising or labelling. The seller shall not be bound by such public statements if he proves that he was unaware and could not reasonably be expected to be aware of the statement in question, that the statement in question had been corrected at the time of conclusion of the contract, or that the statement could not influence the decision to buy the product.
6. It will only be understood that the possible failure or lack of conformity of the product already existed when it was delivered if it is manifested within a period of 6 months from the date of delivery (unless proven otherwise or when this presumption is incompatible with the nature of the product or the nature of the lack of conformity). In the event that the failure or lack of conformity occurs after these first six months have elapsed, the client will be obliged to demonstrate that the problem is from the factory and has not been caused by misuse of the product, incorrect handling of it or of the passage of time.
7. In this case, it will be necessary to resort to an appraisal of the article that is capable of detecting and identifying the cause of the lack of conformity, as well as if it has been caused by misuse or not of the device. If it is finally shown that the fault came from the factory, the client will have the right to enjoy and benefit from the guarantee. However, the possible cost of the expertise will be borne by the client.
8. There will be no liability on the part of IT3D for any lack of conformity that the consumer and user knew or could not reasonably have ignored at the time of signing the contract or that originate from materials supplied by the consumer and client. Likewise, deficiencies caused by negligence, blows, improper use or manipulation, unsuitable voltage, incorrect installation carried out by unauthorized personnel, or materials subjected to wear due to normal use are not included.
9. If, indeed, the product is shown not to be in accordance with the contract, IT3D will offer the client the possibility of choosing between repairing or replacing it, except in the case that one of these two options is objectively and reasonably impossible or disproportionate. It is understood as disproportionate that option that, compared to the other, entails unreasonable costs for IT3D (taking into account the value that the product would have if there were no lack of conformity, its relevance and as long as the alternative can be carried out without major inconvenience for the client).
10. In the event that the product cannot be repaired and cannot be replaced by another with identical characteristics, the customer may request a price reduction, a refund or the replacement of the product with a different one (with characteristics not identical) that he himself can choose. In the case of opting for a price reduction, this reduction will be at the discretion of IT3D, which will communicate the amount thereof to the client as soon as possible. If the client chooses to replace the product with a different one, IT3D will make the payment for the current article and proceed to bill the new product.

15. IT3D Warranty
1. IT3D provides this Limited Warranty to purchasers of IT3D products included in the sales package (“Product”).
2. IT3D warrants to you that during the warranty period IT3D or a service company authorized by IT3D will remedy, free of charge within a commercially reasonable time, defects in materials, design and workmanship by repair or, in the event that IT3D deemed necessary at its discretion, the replacement of the Product, in accordance with this Limited Warranty (except as otherwise provided by law).
3. This Limited Warranty will only be valid and in force in the country of acquisition of the product as long as IT3D has destined the Product for sale in that country and it has been marketed by IT3D. In these cases, a distributor may also manage said warranty directly with IT3D Warranty and return period

5. The warranty period will begin at the time of the original purchase of the Product by the first end user and will cover a period of TWELVE months if the sale is made to a company or TWENTY-FOUR if the purchase is made by an individual . 6. IT3D guarantees that the Products comply with the specifications contained in its offers as long as they have been handled, transported, stored and used in accordance with the instructions contained in the respective User Manuals provided by IT3D. Consequently, IT3D assumes its responsibility only with respect to those non-conformities and defects that have been proven to have been caused by actions or negligence committed prior to the time of delivery of the Products to the first carrier.
7. The client will inspect the Products immediately upon receipt and will inform IT3D or directly to INTERNATIONAL TECHNOLOGY 3D PRINTERS SL through the email info@it3d.com in writing about any complaint or claim regarding the Product attributable to IT3D within the period of fourteen (14) calendar days from delivery.
8. To the extent permitted by country law, the Warranty Period will not be extended or renewed or otherwise affected due to subsequent resale, repair or replacement of the Product authorized by IT3D. However, the repaired part(s) or replacement products supplied during the Warranty Period will be warranted for the remainder of the original Warranty Period or for six (6) months from the date of repair. or replacement, whichever is higher.
9. Everything that is not expressly provided in these General Conditions, is provided “as is”, for which reason no explicit or implicit guarantees are offered, derived from the law or from any other instance in relation to the Product(s). ). How to obtain warranty service

When making a claim under this Limited Warranty you must provide: a) the Product (or affected part) and b) the original proof of purchase, clearly indicating the name and address of the seller, date and place of purchase, the type of product and the serial number. What does not cover? This Limited Warranty does not cover:

User manuals or third-party software, configuration, content, data or links, included or downloaded in the Product, included during installation, assembly, shipment or at any other time in the delivery chain or otherwise acquired and in any way for you. IT3D does not warrant that the IT3D Printer(s) software will meet your needs, will work in combination with any third party hardware or software, or that the operation of any software will be uninterrupted or error free. , nor that any defect present in the software can be rectified or be rectified.
14 . Normal wear and tear (including, but not limited to, LCD screen, nozzle, extruder, drive belts, print beds, or clogged extruder). 17. All Product parts or other equipment replaced by IT3D shall become the property of IT3D. When the Product is not covered by the terms and conditions of this Limited Warranty, IT3D and its authorized service companies reserve the right to charge a fee for labor.
18. In the repair or replacement of the Product, IT3D may use new products or parts, equivalent to new or reconditioned.
19. Your Product may include items specific to your country, including software. When the Product has been re-exported from its original destination country to another country, the Product may include country-specific items that are not considered defects under this Limited Warranty. Limitation of IT3D’s liability
20. This Limited Warranty is your sole and exclusive warranty against IT3D and IT3D’s sole and exclusive liability for defects in your Product. This Limited Warranty is in lieu of all other responsibilities and warranties of IT3D, whether oral, written, statutory (non-binding), contractual, tort, or otherwise, including, without limitation and to the extent permitted by applicable law, any implied conditions, warranties or other terms and conditions relating to satisfactory quality or fitness for a particular purpose.
21. However, this Limited Warranty shall not exclude or limit i) any of your statutory (mandatory) rights under applicable national law or ii) any of your rights against the seller of the Product.
22. To the extent permitted by applicable law, IT3D shall not be liable for any loss or damage or distortion of data, any loss of profit, loss of use of any Products or functionality, loss of business, loss of contracts, loss of profits or loss of anticipated savings, increased costs or expenses, any indirect damages or losses, consequential damages or losses, or special damages or losses.
23. To the extent permitted by applicable law, IT3D’s liability shall be limited to the purchase value of the Product. The foregoing limitations shall not apply in the event of gross negligence or willful misuse on the part of IT3D or in the event of death or personal injury resulting from proven negligence on the part of IT3D
Important Notice: Your product is a sophisticated electronic device. IT3D strongly recommends that you refer to the user guide and instructions provided with and relating to the Product. You should also be aware that the Product may include high-precision displays and other similar parts that may be subject to scratches or other damage when not handled with extreme care. In no case does this Guarantee cover this type of event.
16. Independence of the clauses
1. If any of these conditions of sale or any of the provisions of a Contract were declared by a competent authority invalid, illegal or unenforceable to any extent, said condition or provision will be to that same extent separated from the rest of the conditions and provisions, which will continue to be valid to the fullest extent permitted by law.
17. Modifications of the general conditions
1. IT3D reserves the right to modify these General Conditions at any time and without prior notice. These modifications will be published on the website so that the user can know them before proceeding to use them. These modifications will enter into force at the time of their publication on the Web. Consequently, the user must carefully read these General Conditions each time they proceed to use the website. The use of the page and/or use of the services, once the General Conditions that are applicable have been modified, will mean their acceptance by the user.
2. IT3D reserves the right to modify the commercial offer presented on the website (modifications to products, prices, promotions and other commercial and service conditions) at any time.
18. Communications
1. For the purposes of notifications, IT3D expressly designates the address that appears in these General Conditions and as for the user, he expressly designates the address by the person entered in the registration process in the “My Account” section. Likewise, the user expressly accepts that any type of communication addressed to him (except advertising communications from IT3D if the user has not consented to said type of shipments or has exercised his right to revoke such advertising shipments) is carried out through the email address provided by him. Any change of address or email address must be communicated in writing to the other party for it to be effective for the purposes of future notifications.
19. Interruption of service
1. IT3D may temporarily interrupt the provision of the service due to force majeure, such as strikes in the means used to send the items sold, or for any other cause that prevents the normal provision of the service. Said temporary interruption will not entitle the user to receive any type of compensation for any damage that the interruption of the service could cause, except for the refund of the amount of the service that could not be provided.
20. Data protection
1. When personal data is requested, it will be collected and processed in accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of natural persons in regarding the processing of personal data and the free movement of these data (GDPR). 21. Final provisions
1. All rights, including but not limited to copyright, intellectual property rights, rights in the name, Internet domain name, the Website and the templates, forms and logos accessible through the Online Store (except for the logos and photographs used to present the Products and whose copyrights belong to third parties) belong to IT3D. These rights, as well as the elements on which they are based, may only be used with the written consent of IT3D and under the conditions specified by IT3D.
2. IT3D also declares that the public nature of the Internet network and the use of services provided by electronic means may entail risks of fraudulent obtaining and modification of customer or user data by unauthorized persons. Therefore, IT3D recommends the client or user to use the appropriate technical means to minimize the risks indicated above, in particular, the use of antivirus and identity protection programs on the Internet. In addition, IT3D reminds the client or user that it will never request their password or personal codes in any way.
3. The client or user undertakes not to use the resources or functions of the Online Store for any activity contrary to the interests of IT3D, that is, and without this list being exhaustive, (i) advertising activities related to another Professional or with products other than those offered by IT3D, (ii) the publication of content not related to the activities of IT3D, (iii) the publication of illegal, false or misleading content.
22. Applicable Law, Online Dispute Resolution and Competition
1. The terms and conditions that regulate the relationship between IT3D and the Client are governed by Spanish law.
2. In case of conflicts, the consumer user can resort to the online dispute resolution service through the following address: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main .home2.show&lng=ES
3. Notwithstanding the foregoing, the Courts and Tribunals of the Consumer’s domicile will be competent to resolve any conflict that may arise between the Client acting as a consumer and IT3D.
